(CSE) fusionne et remplace le comit\u00e9 d\u2019entreprise (CE), les d\u00e9l\u00e9gu\u00e9s du personnel (DP) et le comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail (CHSCT).&nbsp;<\/p>\n<p>Toutes les instances de CE ont \u00e9t\u00e9 remplac\u00e9s par des CSE fin 2019.<\/p>\n<p>Des \u00e9lus si\u00e8gent au CSE; leurs nombres peut vari\u00e9s selon l\u2019effectif de l\u2019entreprise. Ainsi, pour une entreprise de 75 \u00e0 99 salari\u00e9s, il y aura 5 titulaires et 5 suppl\u00e9ants, chacun \u00e9lus pour une dur\u00e9e de 2 \u00e0 4 ans, selon les accords avec l\u2019entreprise.<\/p>\n<p>Le CSE est pr\u00e9sid\u00e9 par l\u2019employeur qui peut \u00eatre assist\u00e9 ou remplac\u00e9 par des repr\u00e9sentants (par exemple le Que feront concr\u00e8tement les \u00e9lus du CSE pour les salari\u00e9s ? Au sein du CSE, leurs attributions s\u2019\u00e9tendront \u00e0 de nombreux domaines :\u00a0<a href=\"https:\/\/www.cftc.fr\/actualites\/evaluation-conditions-de-travail-role-cse\">l\u2019am\u00e9lioration des conditions de travail<\/a>, la promotion de la sant\u00e9 et de la s\u00e9curit\u00e9, mais aussi l\u2019acc\u00e8s aux activit\u00e9s sociales et culturelles pour tous les salari\u00e9s de l\u2019entreprise.<\/p><p>La d\u00e9l\u00e9gation du personnel au CSE reprend globalement les fonctions des d\u00e9l\u00e9gu\u00e9s du personnel (dans les entreprises de 11 \u00e0 49 salari\u00e9s), et celles du CE et du CHSCT dans les entreprises d\u2019au moins 50 salari\u00e9s. Ses \u00e9lus vous aident \u00e0 faire valoir vos droits et d\u00e9fendent vos int\u00e9r\u00eats aupr\u00e8s de l\u2019employeur.<\/p><p><strong>\u00c9lections professionnelles : quels enjeux pour les organisations syndicales ?<\/strong><\/p><p>Seules les\u00a0<a href=\"https:\/\/www.cftc.fr\/actualites\/role-dun-syndicat-sorganise-t\">organisations syndicales<\/a>\u00a0peuvent pr\u00e9senter une liste de candidats au 1er tour. Ces \u00e9lections professionnelles constituent un moment crucial pour les OS. Elles conditionnent :<\/p><ul><li>la possibilit\u00e9 d\u2019avoir des \u00e9lus qui d\u00e9fendront l\u2019int\u00e9r\u00eat des salari\u00e9s au sein du CSE ;<\/li><li>leur repr\u00e9sentativit\u00e9, \u00e0 tous les niveaux (entreprise, branche, niveau national)<\/li><li>la possibilit\u00e9 de d\u00e9signer un d\u00e9l\u00e9gu\u00e9 syndical dans l\u2019entreprise (si le score minimal de 10 % est atteint au 1er tour) ;<\/li><li>leur participation \u00e0 la n\u00e9gociation des accords collectifs.<\/li><\/ul><p>Les organisations syndicales assurent \u00e9galement leur r\u00f4le de n\u00e9gociation, via la r\u00e9daction du PAP (protocole d\u2019accord pr\u00e9\u00e9lectoral). Celui-ci est n\u00e9goci\u00e9 avec l\u2019employeur et porte notamment sur l\u2019organisation et le d\u00e9roulement du scrutin.<\/p><p>Pour permettre la mise en place du CSE dans les meilleures conditions, la CFTC encourage les organisations syndicales \u00e0 engager une deuxi\u00e8me n\u00e9gociation, distincte du PAP. Objectif : tirer parti des nouvelles dispositions pr\u00e9vues par la loi.<\/p><p>Les \u00e9lections professionnelles repr\u00e9sentent un moment charni\u00e8re dans la vie d\u2019une entreprise. Avec\u00a0<a href=\"https:\/\/www.cftc.fr\/actualites\/quest-comite-social-economique-cse\">l\u2019arriv\u00e9e du CSE<\/a>, la tenue de ces \u00e9lections rev\u00eat une importance nouvelle, tant pour le salari\u00e9 que pour le candidat. Sa mise en place ouvre la voie \u00e0 d\u2019importantes n\u00e9gociations en amont des \u00e9lections, \u00e0 un champ d\u2019action \u00e9tendu pour les futurs \u00e9lus et \u00e0 une repr\u00e9sentation sur mesure des travailleurs. C\u2019est aussi l\u2019occasion pour les salari\u00e9s \u00e9lecteurs de s\u2019exprimer et de participer activement \u00e0 la r\u00e9ussite du dialogue social dans
