Il s&rsquo;agit de permettre \u00e0 des volontaires parmi les intercontrats de prendre un cong\u00e9 pay\u00e9 50%. Ce cong\u00e9 s&rsquo;accompagne d&rsquo;une suspension du contrat de travail et la perte d&rsquo;un certain nombre de droits.<\/p>\n<p>Pour la CFTC, la responsabilit\u00e9 de l\u2019employeur est d\u2019affecter une activit\u00e9 \u00e0 l\u2019ensemble de ses salari\u00e9s. Plut\u00f4t que de se soumettre \u00e0 cette obligation, Capgemini propose dans ce projet \u00ab\u00a0Cong\u00e9 Respiration\u00a0\u00bb de payer moiti\u00e9 moins les salari\u00e9s en intermission et de r\u00e9duire leurs droits en \u00e9change d\u2019une exemption de pr\u00e9sence.<\/p>\n<h3>Les principaux points de blocage que la CFTC identifie \u00e0 ce stade sont :<\/h3>\n<ul>\n<li>La l\u00e9galit\u00e9 de ce dispositif,<\/li>\n<li>Des dispositions incompatibles avec notre cadre social,<\/li>\n<li>Le fait que l\u2019entreprise n\u2019ait pas jug\u00e9 utile de n\u00e9gocier avec les Organisations Syndicales Repr\u00e9sentatives ni de consulter les Instances Repr\u00e9sentatives du Personnel,<\/li>\n<li>Un projet qui se r\u00e9clame de la strat\u00e9gie RH mais qui ne nous a pas \u00e9t\u00e9 pr\u00e9sent\u00e9 lors des orientations strat\u00e9giques RH 2024, ce qui pose question sur la loyaut\u00e9 du dialogue social.<\/li>\n<\/ul>\n<p>La CFTC demande l\u2019abandon du projet pilote et l\u2019ouverture imm\u00e9diate d\u2019une n\u00e9gociation sp\u00e9cifique sur ce dispositif avec les syndicats.<\/p>\n<h3 class=\"css-4qqigx\" data-slate-node=\"element\"><span data-slate-node=\"text\"><span class=\"css-kyh8ya\" data-slate-leaf=\"true\">L&rsquo;id\u00e9e en elle-m\u00eame est excellente, sociale, et r\u00e9pond \u00e0 bien de besoins. <\/span><\/span><\/h3>\n<p class=\"css-4qqigx\" data-slate-node=\"element\"><span data-slate-node=\"text\"><span class=\"css-kyh8ya\" data-slate-leaf=\"true\">Nous aurions ador\u00e9 n\u00e9gocier un accord sur ce th\u00e8me. ce dispositif, ce sont les coll\u00e8gues sur projet difficile, tellement pris dans le stress qu&rsquo;ils ne voient m\u00eame pas qu&rsquo;ils s&rsquo;ab\u00eement la
